Appen Curbie – Parkeringsregler ("Curbie", "appen", "Tjänsten") tillhandahålls av Staffan Kilnes ("vi", "oss", "vår"). Genom att använda Curbie accepterar du dessa användarvillkor. Om du inte accepterar villkoren — använd inte appen.

Vi kan när som helst uppdatera dessa villkor genom att publicera en ny version på denna sida. Det är ditt ansvar att följa förändringar. Fortsatt användning efter en uppdatering innebär att du accepterar de nya villkoren.

Viktigt om parkeringsregler. Curbie är ett hjälpmedel som visar parkeringsregler baserat på datakällor som kan vara ofullständiga eller inaktuella. Du är alltid själv ansvarig för att följa skyltning och gällande regler på platsen. Vi ansvarar inte för parkeringsböter, felparkeringsavgifter, bortforsling eller andra konsekvenser av att du litar på informationen i appen.

1. Allmänna villkor

Du intygar att du är myndig i ditt land/din region, eller att du har målsmans samtycke för att använda Tjänsten.

Du får inte använda appen för olagliga eller obehöriga ändamål, eller på sätt som strider mot lokal lag.

Du får inte sprida virus, skadlig kod eller annan kod av destruktiv natur via Tjänsten.

Brott mot dessa villkor kan leda till att din åtkomst till Tjänsten omedelbart avslutas.

2. Korrekthet och aktualitet av information

Parkeringsregler ändras. Gatuarbeten, tillfälliga skyltar, säsongsregler och kommunala beslut kan göra att informationen i appen avviker från verkligheten. Vi gör vårt bästa för att hålla data uppdaterad men lämnar inga garantier för att den är komplett, korrekt eller aktuell.

Information i Tjänsten är endast vägledande och ska inte användas som enda underlag för beslut. Du är ansvarig för att kontrollera den faktiska skyltningen på platsen.

3. Ändringar av Tjänsten

Vi förbehåller oss rätten att när som helst ändra, pausa eller avsluta hela eller delar av Tjänsten utan föregående meddelande. Vi är inte ansvariga gentemot dig eller tredje part för ändringar, avbrott eller nedläggning av Tjänsten.

4. Konto och säkerhet

Inloggning sker via Apple-inloggning. Du ansvarar för att skydda din Apple-ID och de enheter där du är inloggad. Misstänker du att ditt konto har komprometterats — kontakta oss.

5. Delade fordon

Om du bjuder in andra användare till ett delat fordon delar du viss information om fordonet och dess parkeringar med dem. Bjud bara in personer du litar på. Du kan när som helst återkalla en inbjudan eller ta bort en deltagare från ett fordon du äger.

6. Pris

Curbie tillhandahålls för närvarande utan kostnad. Vi förbehåller oss rätten att i framtiden införa avgifter eller prenumerationer; sådana förändringar kommer i så fall att meddelas i appen och i App Store.

7. Tredjepartstjänster

Tjänsten använder tredjepartsleverantörer (i första hand Google Firebase och Apple). Vi ansvarar inte för dessa leverantörers tjänster, deras tillgänglighet eller deras egna villkor.

8. Förbjuden användning

Utöver övriga begränsningar i dessa villkor får du inte använda Tjänsten:

för olagliga ändamål eller för att uppmana andra till olagliga handlingar;
för att kränka immaterialrättigheter;
för att trakassera, kränka, hota, ärekränka eller diskriminera baserat på kön, sexuell läggning, religion, etnicitet, ras, ålder, nationellt ursprung eller funktionsvariation;
för att skicka falska eller vilseledande uppgifter;
för att ladda upp virus eller annan skadlig kod;
för att samla in eller spåra andras personuppgifter;
för spam, phishing, skrapning eller automatiserad insamling;
för att kringgå Tjänstens säkerhetsmekanismer.

9. Ansvarsfriskrivning och ansvarsbegränsning

Tjänsten tillhandahålls "i befintligt skick" och "som tillgänglig", utan några garantier av något slag, vare sig uttryckliga eller underförstådda. Vi garanterar inte att Tjänsten är felfri, ständigt tillgänglig, säker eller att resultaten av användning är korrekta eller pålitliga.

I den utsträckning lagen tillåter ansvarar Staffan Kilnes inte för någon direkt, indirekt, tillfällig, särskild, straffbar eller följdskada — inklusive men inte begränsat till uteblivna intäkter, förlorad data, eller parkeringsböter / felparkeringsavgifter / bortforslingskostnader — som uppstår genom din användning av Tjänsten, även om vi blivit informerade om risken för sådan skada.

10. Skadestånd (indemnification)

Du går med på att hålla Staffan Kilnes skadeslös från krav, fordringar eller skäliga ombudsarvoden från tredje part som uppstår på grund av att du brutit mot dessa villkor eller på grund av lag eller tredje parts rättigheter.

11. Ogiltighet av enskild bestämmelse

Om någon del av dessa villkor bedöms olaglig, ogiltig eller icke verkställbar, ska den delen ändå ges verkan i den utsträckning lagen tillåter, och övriga bestämmelser fortsätter att gälla.

12. Uppsägning

Dessa villkor gäller tills de sägs upp av dig eller oss. Du kan när som helst säga upp dem genom att sluta använda Tjänsten och ta bort appen. Vi kan säga upp dem och avsluta din åtkomst till Tjänsten om du brutit mot villkoren.

13. Hela avtalet

Dessa villkor, tillsammans med vår integritetspolicy, utgör hela avtalet mellan dig och oss avseende Tjänsten och ersätter tidigare avtal eller överenskommelser i samma fråga.

14. Tillämplig lag

Dessa villkor regleras av svensk lag. Tvister ska avgöras av svensk allmän domstol, om inte tvingande konsumenträtt på din hemvistort föreskriver annat.

Overview

The Curbie – Parkeringsregler app ("Curbie", "the app", "the Service") is operated by Staffan Kilnes ("we", "us", "our"). By using Curbie, you agree to these Terms of Service. If you do not agree, please do not use the app.

We may update these terms at any time by posting a new version on this page. It is your responsibility to follow the changes. Continued use of the Service after an update constitutes acceptance of the new terms.

Important about parking rules. Curbie is an aid that displays parking rules based on data sources that may be incomplete or out of date. You are always personally responsible for following the posted signs and applicable rules at your location. We are not responsible for parking fines, illegal-parking fees, towing costs, or other consequences of relying on the information shown in the app.

1. General conditions

You represent that you are of legal age in your jurisdiction, or that you have the consent of a legal guardian to use the Service.

You may not use the app for illegal or unauthorized purposes, or in ways that violate local law.

You must not transmit viruses, malware, or any code of a destructive nature through the Service.

A breach of these terms may result in immediate termination of your access to the Service.

2. Accuracy and timeliness of information

Parking rules change. Roadworks, temporary signs, seasonal rules, and municipal decisions may cause information in the app to differ from reality. We make a best-effort attempt to keep data current but make no guarantees that it is complete, accurate, or up to date.

Information in the Service is provided for guidance only and should not be relied upon as the sole basis for decisions. You are responsible for verifying the actual signage at the location.

3. Modifications to the Service

We reserve the right at any time to modify, pause, or discontinue the Service (or any part of it) without prior notice. We are not liable to you or to any third party for any modification, interruption, or discontinuation of the Service.

4. Account and security

Sign-in is provided via Apple Sign-In. You are responsible for protecting your Apple ID and the devices where you are signed in. If you suspect that your account has been compromised, please contact us.

5. Shared vehicles

If you invite other users to a shared vehicle, you share certain information about the vehicle and its parkings with them. Only invite people you trust. You may revoke an invite or remove a member from a vehicle you own at any time.

6. Pricing

Curbie is currently provided free of charge. We reserve the right to introduce fees or subscriptions in the future; any such change will be communicated in the app and on the App Store.

7. Third-party services

The Service relies on third-party providers (primarily Google Firebase and Apple). We are not responsible for those providers' services, their availability, or their own terms.

8. Prohibited uses

In addition to the other restrictions in these terms, you may not use the Service:

for any unlawful purpose or to solicit others to perform unlawful acts;
to infringe upon intellectual property rights;
to harass, abuse, threaten, defame, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;
to submit false or misleading information;
to upload viruses or any other malicious code;
to collect or track other people's personal information;
for spam, phishing, scraping, or automated collection;
to interfere with or circumvent the Service's security features.

9. Disclaimer of warranties; limitation of liability

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, secure, or that the results obtained from use of the Service will be accurate or reliable.

To the fullest extent permitted by law, Staffan Kilnes shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages — including but not limited to lost revenue, lost data, or parking fines / illegal-parking fees / towing costs — arising from your use of the Service, even if we have been advised of the possibility of such damages.

10. Indemnification

You agree to indemnify and hold harmless Staffan Kilnes from any claim, demand, or reasonable attorneys' fees made by a third party arising out of your breach of these terms or your violation of any law or third-party rights.

11. Severability

If any provision of these terms is found to be unlawful, void, or unenforceable, that provision shall nonetheless be enforced to the fullest extent permitted by law, and the remaining provisions shall continue in full force and effect.

12. Termination

These terms remain in effect until terminated by you or us. You may terminate them at any time by ceasing use of the Service and removing the app. We may terminate them and revoke your access to the Service if you have breached the terms.

13. Entire agreement

These terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreement or understanding on the same subject.

14. Governing law

These terms are governed by the laws of Sweden. Disputes shall be resolved by the Swedish general courts, unless mandatory consumer-protection law in your place of residence provides otherwise.
